The pandemic has\nmade working from home a reality that is unlikely to change. Instant forms of\ncommunication are the norm; email is becoming pass\u00e9. Collaboration platforms\nlike Zoom and Teams are now staples at organizations large and small, accessible\nfrom our desktops, laptops, and mobile devices. <\/p>\n\n\n\n<p>Additionally, people are more attached to their mobile devices\nthan <em>any other object<\/em> in their possession. The ability to create new electronically\nstored information (ESI) on the fly with a mobile device means the volume and\nsources of evidence created are growing and can be crucial to fact development\nin litigation. Further, using our mobile devices is commonplace in business. Our\nphones hold our personal and professional lives: our schedules, contacts,\nsocial posts, texts, pictures, audio and video files, communications with\nfamily, friends, and business colleagues\u2026they have become our link to the\nworld. <\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright size-large is-resized\"><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.oasisdiscovery.com\/ediscovery-unredacted\/wp-content\/uploads\/2021\/06\/evolution-of-ediscovery-technology-2-236x1024.jpg\" alt=\"\" class=\"wp-image-775\" width=\"256\" height=\"1111\" srcset=\"https:\/\/www.oasisdiscovery.com\/ediscovery-unredacted\/wp-content\/uploads\/2021\/06\/evolution-of-ediscovery-technology-2-236x1024.jpg 236w, https:\/\/www.oasisdiscovery.com\/ediscovery-unredacted\/wp-content\/uploads\/2021\/06\/evolution-of-ediscovery-technology-2-69x300.jpg 69w, https:\/\/www.oasisdiscovery.com\/ediscovery-unredacted\/wp-content\/uploads\/2021\/06\/evolution-of-ediscovery-technology-2-354x1536.jpg 354w, https:\/\/www.oasisdiscovery.com\/ediscovery-unredacted\/wp-content\/uploads\/2021\/06\/evolution-of-ediscovery-technology-2.jpg 361w\" sizes=\"(max-width: 256px) 100vw, 256px\" \/><\/figure><\/div>\n\n\n\n<p>Beyond billions of texts, tweets, IMs, and social posts\u2026new data\ntypes are emerging and evolving constantly (enter Clubhouse, which poses the\nchallenge of collecting audio files from an invite-only platform). The use of these\ndata types has skyrocketed in the last three years, and they are now ubiquitous\nin our culture. And yet, eDiscovery software is not evolving fast enough to\nhelp lawyers deal with the data\u2014whether in collection, review, production, or\npresentation to a jury. Effectively dealing with any of these \u201cnon-standard\u201d\nforms of data requires a level of complexity that most teams and lawyers don\u2019t\nhave. Finding the right tool for a specific type of data is hard if you don\u2019t\ndo eDiscovery every day, which most lawyers don\u2019t. There is no single tool that\nhandles the universe of data types that are currently flooding the industry. As\nit was recently discussed at the <a href=\"https:\/\/ufediscoveryconference.com\/\">University of Florida eDiscovery\nConference<\/a>, there are data types for which collection tools either don\u2019t\nexist or haven\u2019t yet adapted.<\/p>\n\n\n\n<p>Handling the new data types shared here requires the development of features and connectors by software companies. Custom development costs money, and smart companies are asking how building a specific feature will grow revenue. If only 1% of cases ever use TikTok data, what is the potential ROI for connecting to TikTok? Not very high. And, while the pandemic has created phenomenal growth in the use of Microsoft Teams, there is currently no solution for handling all aspects of that type of data. <\/p>\n\n\n\n<p>Recent examples make it clear how difficult it is for developers\nto keep pace with the changes.<\/p>\n\n\n\n<ul><li>In advance of the 2020 presidential election (based on allegations of interference from the 2016 contest), <a href=\"http:\/\/www.princeton.edu\/~fujiwara\/papers\/Social_Media_and_Vote_Outcomes.pdf\">social media platforms changed their APIs<\/a>, precluding existing social media tools from working as they had previously. See also, \u201c<a href=\"https:\/\/www.bbc.com\/news\/technology-54738873\">How Social Media is Preparing for US Election Chaos<\/a>.\u201d<\/li><li>Google recently <a href=\"https:\/\/gizmodo.com\/how-to-get-ready-to-switch-from-google-hangouts-to-goog-1845801333\">changed how its chat feature works<\/a>, relocating where it stores chat data.<\/li><li>Adobe <a href=\"https:\/\/blogs.windows.com\/msedgedev\/2020\/09\/04\/update-adobe-flash-end-support\/\">discontinued the support of its Flash Player<\/a> (a common integration for tools) as of December 31, 2020, which meant standardized processes were immediately impacted. <\/li><\/ul>\n\n\n\n<p>Changes like these mean companies building tools to collect and\nmanage data are <em>constantly<\/em> re-engineering to accomplish the same tasks. <\/p>\n\n\n\n<p>While our tools may not be meeting the challenges that lawyers\nface, that is not stopping courts from requiring the production of data from\nthese sources of ESI. In fact, judges across the country are recognizing the\nrelevance of the discovery of multiple instant messaging platforms, chat\nmessaging, and other short message format applications.<\/p>\n\n\n\n<ul><li><a href=\"https:\/\/app.ediscoveryassistant.com\/case_law\/31909-dr-distribs-v-21-century-smoking\"><em>DR\nDistribs. V. 21 Century Smoking<\/em>, January 21, 2021 (N.D. Ill.\n2021)<\/a> awarded sanctions for spoliation of Yahoo! chat and\nweb mail accounts.<\/li><li><a href=\"https:\/\/app.ediscoveryassistant.com\/case_law\/32281-in-re-citibank-august-11-2020-wire-transfers\"><em>In\nre Citibank August 11, 2020 Wire Transfers<\/em>, February\n16, 2021 (S.D.N.Y. 2021)<\/a>&nbsp;relied on Slack\nmessages as evidence. <\/li><li><a href=\"https:\/\/app.ediscoveryassistant.com\/case_law\/32557-wan-v-debolt\"><em>Wan\nv. Debolt<\/em>, February 25, 2021 (C.D. Ill. 2020)<\/a>&nbsp;ordered the production of WeChat, WhatsApp, Facebook\nMessenger, and text messages.<\/li><\/ul>\n\n\n\n<p>So, we are left with this question: how do we provide juries the data they need to see, in a format they are used to while balancing ever-changing data sources and corporate ROI? i.e., can eDiscovery keep up with us?<\/p>\n\n\n\n<p>There are many responses that could be given to this question and in varying degrees, they all may be accurate. There is no lack of creativity and development happening in every corner of the industry to customize solutions within the confines of the existing software available.
